Terms of Service

This page is the public terms of service and end-user license agreement for the Kubo apps on iOS and Android, including Play Store and App Store listings.
Acceptance of these terms
These Terms of Service (“Terms”) are a legal agreement between you and Kubo (“we”, “us”) covering your use of the Kubo mobile apps, the website at kubo-bear.app, and related services (together, the “Service”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy at https://kubo-bear.app/privacy. If you do not agree, do not use the Service.
Who may use Kubo
You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract.
Kubo is a tool for parents and caregivers. Child profiles and logs are created and managed by adult account holders. Do not let a child create their own account.
You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly if you believe your account has been compromised.
Your license to use the app
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Kubo app on devices you own or control, for your own family’s use, in accordance with these Terms and the applicable app store rules.
You may not copy, modify, reverse engineer, resell, rent, or create derivative works from the Service, or use it to build a competing product, except where such restrictions are prohibited by law.
Subscriptions, billing, and renewals
Kubo offers a free tier and optional paid plans (currently “Kubo Premium” and “Kubo Family”), available as monthly or yearly auto-renewable subscriptions. Plan names, features, and prices are shown in the app before you buy and may change over time.
Purchases are processed by Apple’s App Store or Google Play, not by Kubo. Payment is charged to your store account when you confirm the purchase.
Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your store account is charged for renewal within 24 hours before the period ends.
You can view, manage, or cancel a subscription any time in your App Store or Google Play account settings. Cancelling stops future renewals; it does not retroactively refund the current period.
Any free trial or introductory offer, if available, is shown at checkout. If you subscribe during a free trial, the unused portion of the trial is forfeited. Refunds are handled by Apple or Google under their policies; Kubo generally cannot issue store refunds directly.
If a payment fails or a subscription lapses, paid features turn off and your account returns to the free tier. Your existing logs remain available subject to free-tier limits.
Your content
You keep ownership of the information you add to Kubo — child profiles, logs, notes, photos, and video (“Your Content”).
You grant us a limited license to host, store, process, and display Your Content solely to operate and improve the Service for you and the family members you invite, including syncing across devices and powering features you choose to use, such as Ask Kubo.
You are responsible for Your Content and for having the right to share any information or media you upload, including about other people.
Acceptable use
Do not use the Service to break the law, infringe others’ rights, upload malware, attempt to gain unauthorized access, disrupt the Service, or scrape or overload our systems.
Do not use the Service to store or share content that is unlawful, abusive, or harmful to children.
We may suspend or terminate accounts that violate these Terms or that create risk or legal exposure for us or other users.
Not medical advice
Kubo helps you track and organize care information. It is not a medical device and does not provide medical advice, diagnosis, or treatment.
Insights, charts, growth references, milestone guidance, and Ask Kubo responses are informational only. Always consult a qualified health professional for questions about your child’s health, and call your local emergency number in an emergency.
Third-party services
The Service relies on third parties such as cloud hosting, push notification providers, and AI processing for optional features. Your use of app store features is also governed by Apple’s or Google’s terms.
We are not responsible for third-party services, websites, or content that we do not control.
Intellectual property
The Service, including its software, design, branding, and the Kubo name and mascot, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer any of those rights to you.
Termination
You can stop using the Service at any time and request account deletion at https://kubo-bear.app/delete-account or through in-app account settings.
We may suspend or end your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (for example ownership, disclaimers, and limitation of liability) will continue to apply.
Disclaimers and limitation of liability
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost.
To the maximum extent permitted by law, Kubo and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Changes to the Service and these Terms
We may update, add, or remove features, and we may revise these Terms from time to time. If we make material changes, we will post the updated Terms at https://kubo-bear.app/terms and update the “Last updated” date. Continued use of the Service after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws applicable where Kubo is operated, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections in your country of residence.
Apple App Store — additional terms
These Terms are between you and Kubo only, not with Apple. Apple is not responsible for the app or its content.
Your license to use the app on Apple devices is limited to Apple’s Usage Rules in the App Store Terms of Service.
Kubo, not Apple, is solely responsible for the app and for providing any maintenance and support for it. Apple has no obligation to furnish support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Kubo’s responsibility.
Kubo, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection or privacy law.
Kubo, not Apple, is responsible for investigating and resolving any third-party claim that the app or your use of it infringes that third party’s intellectual property rights.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you.
